RockPoint Online Traders LLC respects copyright and responds to notices under the Digital Millennium Copyright Act (17 U.S.C. § 512).
1What this covers
Summit does not host its users’ videos: media is edited on each user’s own device and is never uploaded to us, so there is no user video on our servers that we could remove. Notices therefore normally concern material we publish on summitcut.com itself. If your concern is a video someone made with Summit and posted elsewhere, please send your notice to the platform where it is posted. We still act on credible reports that an account is being used for repeated infringement.
2Sending a notice
Your notice must be in writing and include:
- your physical or electronic signature
- identification of the copyrighted work you say is infringed
- identification of the material you say infringes, with enough detail for us to locate it, such as a URL
- your name, address, telephone number and email address
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law
- a statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner
3Our designated agent
Copyright Agent, RockPoint Online Traders LLC
4900 Story Rock St NW
Albuquerque, NM 87120, United States
Email: support@summitcut.com
Please put “DMCA notice” in the subject line.
4What happens next
We review each complete notice promptly, remove or disable the identified material where appropriate, and tell the person affected so they can respond.
5Counter-notice
If material you posted was removed and you believe that was a mistake or misidentification, you may send a counter-notice to the agent above with:
- your physical or electronic signature
- identification of the material removed and where it appeared
- a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification
- your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or for Bernalillo County, New Mexico, if you are outside the United States) and will accept service from the person who sent the notice
We forward valid counter-notices to the original complainant and may restore the material 10 to 14 business days later unless they tell us they have filed a court action.
6Repeat infringers
We terminate, in appropriate circumstances, the accounts of users who repeatedly infringe.
7False claims
Under 17 U.S.C. § 512(f), anyone who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages.
